App Disclaimer

1. General Information

The Carebrain mobile application (the "App") is provided by Carebrain, Inc. ("Carebrain," "we," "us," or "our"). This Disclaimer applies to your use of the App and should be read in conjunction with our Terms and Conditions, Privacy Policy, and End User License Agreement.

2. Not a Medical Device

THE APP IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. The App is designed to assist healthcare professionals with clinical documentation and workflows but does not provide medical diagnoses or treatment recommendations.

3. Professional Judgment Required

THE APP DOES NOT REPLACE PROFESSIONAL MEDICAL JUDGMENT. Healthcare professionals using the App remain solely responsible for:

  • All clinical decisions and patient care
  • The accuracy and completeness of all clinical documentation
  • Reviewing and verifying all AI-generated content before finalizing
  • Ensuring compliance with applicable standards of care
  • Maintaining appropriate licensure and professional insurance

4. AI-Generated Content Disclaimer

The App uses artificial intelligence to assist with generating clinical documentation. YOU ACKNOWLEDGE AND AGREE THAT:

  • AI-generated content is provided as a draft only and requires your professional review
  • AI systems can make errors, including in medical terminology, diagnoses, and coding
  • You must verify all AI-generated content against your clinical observations and judgment
  • You bear full responsibility for any content you approve and submit
  • Carebrain is not liable for errors in AI-generated content that you approve

5. No Guarantee of Results

While the App is designed to improve clinical workflow efficiency and documentation quality, we make no guarantees regarding:

  • Time savings or productivity improvements
  • Billing or reimbursement outcomes
  • Reduction in documentation errors
  • Compliance with any specific regulatory requirements
  • Clinical outcomes or patient satisfaction

Results may vary based on individual use, practice settings, and other factors.

6. Telehealth Limitations

If you use the App's telehealth features, you acknowledge that:

  • Telehealth has inherent limitations compared to in-person care
  • Technical issues may affect the quality of telehealth encounters
  • Not all conditions or situations are appropriate for telehealth
  • You are responsible for determining when in-person care is necessary
  • You must comply with all applicable telehealth laws and regulations

7. Third-Party Integrations

The App may integrate with third-party systems, including electronic health records (EHRs). Carebrain is not responsible for:

  • The performance, accuracy, or availability of third-party systems
  • Data transferred to or from third-party systems
  • Any issues arising from third-party system failures or errors
  • Changes to third-party systems that affect App functionality

8. Service Availability

We strive to maintain continuous availability of the App, but we do not guarantee uninterrupted access. The App may be unavailable due to:

  • Scheduled maintenance or updates
  • Technical issues or system failures
  • Network or internet connectivity problems
  • Force majeure events beyond our control

You should have appropriate backup procedures for clinical documentation in case the App is unavailable.

9. Security Disclaimer

While we implement robust security measures to protect information processed through the App, no system is completely secure. You are responsible for:

  • Maintaining the security of your login credentials
  • Using the App only on secure, trusted networks
  • Keeping your device and the App updated
  • Reporting any suspected security incidents promptly

10. Regulatory Disclaimer

Carebrain strives to maintain compliance with applicable healthcare regulations, including HIPAA. However:

  • We do not provide legal or regulatory advice
  • You are responsible for your own regulatory compliance
  • Healthcare regulations vary by jurisdiction and may change
  • You should consult with your own legal and compliance advisors

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREBRAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

  • Clinical decisions or patient outcomes
  • Errors in AI-generated documentation
  • Loss of data or business interruption
  • Regulatory penalties or legal claims
  • Third-party claims related to your healthcare services

12. Changes to This Disclaimer

We may update this Disclaimer from time to time. Material changes will be communicated through the App. Your continued use of the App after changes become effective constitutes acceptance of the updated Disclaimer.
